In November 2025, Congress passed β and the President signed β a full-year federal Agriculture funding bill containing a provision known as Section 781. It rewrites the legal definition of hemp, replacing the old delta-9 THC threshold with a new "total THC" standard that also counts THCA and delta-8, and it caps every finished hemp product at just 0.4 milligrams of total THC per container β not per serving.
That new definition takes effect on November 12, 2026. By outside industry estimates, it would make roughly 95% of the hemp-derived products currently sold in the U.S. federally illegal overnight, including many non-intoxicating, lab-tested, full-spectrum CBD products that have nothing to do with getting anyone high.
Congress created this problem with a last-minute rider, and Congress can fix it. Several bills that would delay or rework the deadline have already been introduced, but none has passed. We're asking lawmakers for one straightforward thing: a one-year extension, so the industry has time to build a real regulatory framework instead of living under a blanket ban.
What the new federal rule actually does
