Is Delta 9 THC Legal?
Short answer: when it’s derived from hemp in concentrations of less than 0.3% by dry weight, yes! In 2018 Congress passed the 2018 Farm Bill, which removed hemp as a federally controlled substance. It also says that any hemp and hemp-derived products that contain less than 0.3% THC by dry weight are considered federally legal in the United States. By this definition, all of our Delta 9 THC products are federally compliant under the standards set by the 2018 Farm Bill. Let’s do the math:
- One cbdMD Delta 9 THC gummy weighs about 6 grams, or 6000 milligrams.
- If we take 0.003 (which is 0.3%) and multiply that by 6000, we are left with 18 milligrams.
- That means that according to the Farm Bill, a 6 gram gummy can contain up to 18 mg of hemp-derived Delta 9 THC.
- We formulated our Delta 9 gummies with only 10 mg of Delta 9 THC, which means the amount of THC we use in our gummies is well below the legal amount.
- But don’t worry, you’ll still feel it working!

DOES DELTA 9 GET YOU HIGH?
When people talk about THC, they are mainly talking about the Delta 9 variant of THC. If you ingest enough THC, you will feel the "high" feeling associated with it. Our gummies include 10 mg of THC, so a high will be felt if you ingest a full gummy. However, we recommend that you stick with our serving size – a quarter of a gummy – when starting out, and then adjust as needed down the road.
Can Delta 9 be shipped?
As long as cannabis products have less than 0.3% THC by dry weight, including Delta 9 THC, they are legal to sell in shops and online. That means that it is totally legal to ship directly to your home. Unfortunately, due to state restrictions, we cannot ship to Arizona, Georgia, Idaho, Minnesota, Nebraska, Oregon, and Pennsylvania.
What is stronger, Delta 9 or Delta 8?
Delta 8 THC is also naturally occurring in hemp, but at much lower concentrations when compared to Delta 9 THC. Because of this, we can create products with Delta 9 THC without having to synthetically recreate it, which makes the product less manufactured and more potent.
Is Delta 9 bad?
We think Delta 9 THC can be good for many people. However, just like in anything in life, there can be too much of a good thing. We recommend sticking to our serving sizes to avoid any negative effects, but you can adjust your serving as needed after a few weeks. Slow and steady wins the race!
